This contract is between Becky and Keith Baxter, of ANUTTA POODLES, hereafter known as seller, and___________________________________________________, Hereafter known as buyer.

Some of the following terms of this contract are negotiable, and any modifications shall be listed under the heading of "Other" and must be signed by all parties.

All modifications shall take the precedence over the provision(s) it replaces.

All involved parties must be in good standing with the AKC, prior to executing the following contract:

1. Seller offers the ( ) pet quality/( ) show prospect Poodle for  $________.

4. Spay/Neuter:

All pets WILL BE spayed or neutered unless other arrangements have been stated in section 16 "OTHER" of this contact.  This makes for a more well rounded dog who doesn't produce unwanted pups from an inexperienced breeding home.  All pets come with American Kennel Club Limited Registration papers.  This means that if bred, no offspring can be registered with AKC.

5. Heath Guarantee:

Vet Check Requirement.  It is buyers responsibility to have the dog examined by a vet within 7 days of receipt, to provide assurance of good health and as a base line for future veterinary reference. If, during this period, dog is determined to have any contagious disease or undisclosed major defect, it can be returned for of refund of all monies paid, except shipping. 

If puppy is found to have crippling Hip Dysplasia, Addison Disease, Sebaceous Adenitis, Blindness of any form, Renal Dysplasia, Cancer, or Liver disease before 5 years of age, as certified by two veterinarians one a specialist, a replacement puppy of equal value will be given at seller's earliest convenience, after proof of spay/neuter surgery is received and the dog is listed on the Poodle Health Registry (www.poodlehealthregistry.com).  It is the responsibility of the Buyer to list the dog on Poodle Health Registry.  No other conditions are covered in this guarantee.  Seller will not pay for any vet bills resulting from any medical issue nor will Seller pay for the specialist to prove this is indeed an issue covered by the contract.  Buyer has the option of allowing Seller to place second puppy for them and sending them a refund for their current dog, or taking the second puppy as their own.  At no time does Seller require first puppy back to receive second puppy or refund from the sale of second puppy.  Only proof that spay/neuter of first puppy is complete.  Buyer may NOT take second puppy and resale.  Seller must always know where each puppy is placed and approve home before placement.

Buyer will keep Seller informed of the health of this dog throughout its life.  A written letter will be sent to Seller each year describing the dog's health, the food it has been eating, and the vet care needed.  This is to help the Seller to know if there are trends, allergy issues, or if a food change is in order, as well as to know which litters seem to be the healthiest and which are not.  Health Guarantee becomes null and void if yearly contact is not maintained by the buyer.

Buyer understands Seller breeds 1-2 litters a year and it may take up to 2 years to receive the replacement puppy.

6. General Care:

Buyer agrees to feed only a quality meat based dog food and/or Raw/Cooked meals containing no Corn or Wheat.  This puppy has been raised on Natures Variety, and Raw/Cooked meals (Nature's Variety Raw as an example).  Fresh water shall be given at all times.  A secure exercise space and shelter will be provided. 

Vet Care:  Buyer agrees to give proper and prompt veterinary care and have this dog seen by a Veterinarian at least once a year for an annual checkup.  Buyer agrees to check into the option of titer testing as a way to cut down on vaccinations.   A Limited Vaccination Program is highly encouraged.  Seller follows the vaccination schedule recommended by Dr Dodds. 7. Grooming:

Buyer agrees to have this dog professionally groomed every 6-8 weeks for the life of the dog.

8. Socialization:

Buyer will attend one class of puppy kindergarten and one 8-week course of obedience or agility  with a qualified instructor. Upon completion, Seller will refund 50 dollars for each coarse attended, up to 100.00 dollars. Proof of attendance must be sent to Seller to receive refund.  Clicker Training or other motivational training is HIGHLY recommended. 

9. Temperament:

Seller guarantees this dogs temperament to be sound at the time of sale and has received correct training and socialization for its age. The sell takes no responsibility for behavioral abnormalities which develop in the dog due to lack of training, discipline, and socialization seven (7) days or more after the time of sale. Refunds/replacements are not offered in this situation but the seller will take the dog back if the owner so desires or try to assist Buyer in finding another home for the dog.

10. Buyer agrees to keep seller notified of current address and phone number.

Buyer will contact Seller by Email, Phone, or Written Letter at least once a year to confirm location of Buyer and give any updated information. Buyer will contact Seller if any contact information is to change.  Pictures and cute stories always welcome! 

11. Right of First Refusal.

In the event that Buyer should ever decide that he/she can no longer keep this Poodle for any reason, Seller shall have the right of first refusal. Buyer shall offer said dog to Seller for a price equal to, or less than, it will be offered to the general public. Only written offers to Seller from Buyer will be legally binding. Said offers shall be made by certified mail, return receipt requested. Buyer shall not sell this dog for 15 days after receipt of notice by Seller. Seller shall have 15 days to respond to Buyers sales offer. If Seller does not respond or declines to purchase this dog, buyer shall be free at the end of the 15-day waiting period to sell said animal to another person at no less than the price offered to Seller. 

If dog is to be sold to a 3rd Party, Buyer must supply Seller with valid contact information of the new owner.  Full name, address, phone, and email shall be sent to Seller before the final transaction takes place.  Sellers contact information shall be supplied to new owners as well.  It will be impossible for me to keep tabs on my pups if they are sold and I do not know with whom they now live.

Seller will ALWAYS take any dog back that a home cannot keep.  Buyer shall NEVER turn this dog over to the Humane Society or an animal shelter of any kind. Dog must be returned to Seller or held until Seller can make arrangements for pick up.

Buyer agrees NEVER to sell this dog to retailers, dealers, and wholesalers, for auction or research, or dog fighting.

12.       Buyer agrees that Seller is not responsible for the actions or safety of this dog, once it leaves Seller's
            possession.  Buyer further agrees to indemnify Seller from any costs that results from such actions.

13       Buyer of all puppies agrees to use seller's kennel name as the pre-fix in the registered name of the dog. 
           Buyer of a show/breeding prospect will supply Seller with a clear photographs suitable for advertising at age six months and one year. 
           Also, all advertising of dog will include breeder's name or kennel name.

14.  American, United, and Canadian Kennel Club title refunds.

Seller will refund 100.00 for each official working title earned under these three Kennel Clubs up to a total of 500.00 dollars.  A copy of new title certificate required for refund.  No other clubs qualify for refunds.

15.  Championship Title Refund.

Seller will refund 500.00 dollars for one AKC Championship title in any working sport (Obedience, Agility, Hunting, Tracking, etc).  ONLY AKC TITLES APPLY.

17.  Breeding/show prospect puppy:

Buyer will never use this dog to create 'designer dogs' and will only breed this dog to fully health tested AKC poodles.
Buyer will not breed this dog before 2 years of age.
Buyer will attain a title from AKC, UKC, or Canadian KC on this dog prior to breeding.  This can be conformation or working.  CGC titles do not qualify.
Buyer will only breed this dog if it passes all health testing.
Health test to include but not limited to OFA and/or Penn Hip, CERF, SA skin punch biopsy, vWD (if not DNA clear by parentage) and blood work for; Addison, Thyroid, Liver, and Kidney function.  All test that can be registered with OFA will be prior to breeding.

All provisions in this contract are designed to safeguard the dog, the breed in general and/or the community, and as such, violation of any provision will cause damage to seller's reputation.

Failure to comply with any provision will result in return of the dog to seller and a $5,000.00 fine for each incident, for said damages.

This contract shall be deemed legally binding and is under the jurisdiction of the State of Colorado

If any provision of the Agreement is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable.

The entire Agreement between the parties is contained herein.
